{"id":27658,"date":"2014-10-09T09:35:04","date_gmt":"2014-10-08T23:35:04","guid":{"rendered":"https:\/\/riskinfo.com.au\/news\/?p=27658"},"modified":"2024-09-25T14:28:43","modified_gmt":"2024-09-25T04:28:43","slug":"asic-life-insurance-advice-review-unacceptable-level-of-failure","status":"publish","type":"post","link":"https:\/\/riskinfo.com.au\/news\/2014\/10\/09\/asic-life-insurance-advice-review-unacceptable-level-of-failure\/","title":{"rendered":"ASIC Life Insurance Advice Review &#8211; &#8216;Unacceptable Level of Failure&#8217;"},"content":{"rendered":"<p>Australia&#8217;s life insurance advice sector has been placed on notice by ASIC following the release of a report that identifies &#8216;&#8230; an unacceptable level of failure&#8217; by advisers to comply with the laws relating to appropriate advice and prioritising the needs of the client.<\/p>\n<p><!--more--><\/p>\n<figure id=\"attachment_27666\" aria-describedby=\"caption-attachment-27666\" style=\"width: 150px\" class=\"wp-caption alignright\"><a href=\"https:\/\/riskinfo.com.au\/news\/files\/2014\/10\/Peter-Kell-2.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-27666\" src=\"https:\/\/riskinfo.com.au\/news\/files\/2014\/10\/Peter-Kell-2.jpg\" alt=\"ASIC Deputy Commissioner, Peter Kell, has placed Australia's life insurance advice sector on notice to improve its standards\" width=\"150\" height=\"180\" \/><\/a><figcaption id=\"caption-attachment-27666\" class=\"wp-caption-text\">ASIC Deputy Commissioner, Peter Kell, has placed Australia&#8217;s life insurance advice sector on notice to improve its standards<\/figcaption><\/figure>\n<p>In a damning assessment, ASIC&#8217;s <a href=\"https:\/\/riskinfo.com.au\/news\/files\/2014\/10\/rep413-published-9-October-2014.pdf\" target=\"_blank\" rel=\"noopener\">Review of Retail Life Insurance Advice<\/a> found that more than one third (37%) of its sample of 200 advice files were considered to have failed to comply with delivering appropriate and compliant client advice.<\/p>\n<blockquote><p>&#8230;the life insurance advice sector needs to improve the quality of advice<\/p><\/blockquote>\n<p>The regulator says the life insurance advice sector needs to improve the quality of advice and ensure that the interests of consumers are given priority.<\/p>\n<p>Part of ASIC&#8217;s review included an investigation to the reasons for the current high level of lapse rates in Australia, which are impacting the industry&#8217;s sustainability.\u00a0 It identified three main causes:<\/p>\n<ol>\n<li>Product innovation by insurers, such as changing actuarial assumptions at underwriting or the redesign of key policy features such as definitions and exclusions, which leads to the repricing of policies<\/li>\n<li>Age-based premium increases affecting affordability<\/li>\n<li>Incentives for advisers to write new business or rewrite existing business to increase commission income<\/li>\n<\/ol>\n<p>The report also identifies a correlation between high up-front commissions and the degree of non-compliant advice being delivered. It says this includes&#8217;&#8230; situations where the recommendation is to switch products.&#8217;<\/p>\n<p>ASIC Deputy Commissioner, <strong>Peter Kell<\/strong>, has urged the life insurance industry to &#8220;&#8230; consider how remuneration and compliance practices can better support good quality outcomes for consumers.&#8221;\u00a0 In doing so, the report makes a number of specific recommendations for both insurers and licensees:<\/p>\n<p><strong>Recommendations for insurers<\/strong><\/p>\n<ul>\n<li>Address misaligned incentives in their distribution channels<\/li>\n<li>Address lapse rates on an industry-wide and insurer-by-insurer basis (e.g. by considering measures to encourage product retention)<\/li>\n<li>Review their remuneration arrangements to ensure that they support good-quality outcomes for consumers and better manage the conflicts of interest within those arrangements<\/li>\n<\/ul>\n<p><strong>Recommendations for licensees<\/strong><\/p>\n<ul>\n<li>Prioritises the needs of the client<\/li>\n<li>Review their business models to provide incentives for strategic life insurance advice<\/li>\n<li>Review the training and competency of advisers giving life insurance advice<\/li>\n<li>Increase their monitoring and supervision of advisers with a view to building \u2018warning signs\u2019 into file reviews and create incentives to reward quality, compliant advice<\/li>\n<\/ul>\n<p>The report was based on a review conducted between September 2013 and July 2014,which considered:<\/p>\n<ul>\n<li>How life insurance is sold by advisers<\/li>\n<li>How advisers are remunerated for that advice<\/li>\n<li>The drivers behind product replacement advice to consumers<\/li>\n<li>The quality of the personal advice consumers receive<\/li>\n<\/ul>\n<p>Mr Kell noted that the regulator is committed to working with the industry to address the problems it has identified and to improve outcomes for consumers.<\/p>\n<p>Following the surveillance work and the conduct that has been uncovered ASIC says it has commenced follow-up investigations in certain cases which are ongoing.<\/p>\n<p>\u2018Where inappropriate advice was provided we are considering enforcement action or other regulatory action\u2019, said Mr Kell.<\/p>\n<p><a href=\"https:\/\/riskinfo.com.au\/news\/files\/2014\/10\/rep413-published-9-October-2014.pdf\" target=\"_blank\" rel=\"noopener\">Click here<\/a> to access ASIC&#8217;s Retail Life Insurance Advice Review.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Australia&#8217;s life insurance advice sector has been placed on notice by ASIC following the release of a report that identifies &#8216;&#8230; an unacceptable level of failure&#8217; by advisers to comply with the laws relating to appropriate advice and prioritising the needs of the client.<\/p>\n","protected":false},"author":3,"featured_media":0,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[8],"tags":[],"class_list":{"0":"post-27658","1":"post","2":"type-post","3":"status-publish","4":"format-standard","6":"category-compliance-regulation","7":"headers-new"},"_links":{"self":[{"href":"https:\/\/riskinfo.com.au\/news\/wp-json\/wp\/v2\/posts\/27658","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/riskinfo.com.au\/news\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/riskinfo.com.au\/news\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/riskinfo.com.au\/news\/wp-json\/wp\/v2\/users\/3"}],"replies":[{"embeddable":true,"href":"https:\/\/riskinfo.com.au\/news\/wp-json\/wp\/v2\/comments?post=27658"}],"version-history":[{"count":0,"href":"https:\/\/riskinfo.com.au\/news\/wp-json\/wp\/v2\/posts\/27658\/revisions"}],"wp:attachment":[{"href":"https:\/\/riskinfo.com.au\/news\/wp-json\/wp\/v2\/media?parent=27658"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/riskinfo.com.au\/news\/wp-json\/wp\/v2\/categories?post=27658"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/riskinfo.com.au\/news\/wp-json\/wp\/v2\/tags?post=27658"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
