{"id":36685,"date":"2017-04-11T22:10:42","date_gmt":"2017-04-11T11:10:42","guid":{"rendered":"https:\/\/riskinfo.com.au\/news\/?p=36685"},"modified":"2017-04-12T08:02:23","modified_gmt":"2017-04-11T21:02:23","slug":"asic-proposes-peer-review-panel-for-banning-actions","status":"publish","type":"post","link":"https:\/\/riskinfo.com.au\/news\/2017\/04\/11\/asic-proposes-peer-review-panel-for-banning-actions\/","title":{"rendered":"ASIC Proposes Peer Review Panel For Banning Advisers"},"content":{"rendered":"<p>ASIC will consider the creation of a three-member peer review panel which would be empowered to recommend the regulator ban financial advisers for misconduct.<!--more--><\/p>\n<figure id=\"attachment_25689\" aria-describedby=\"caption-attachment-25689\" style=\"width: 150px\" class=\"wp-caption alignright\"><a href=\"https:\/\/riskinfo.com.au\/news\/files\/2014\/03\/Greg-Medcraft-2.jpg\" rel=\"attachment wp-att-25689\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-25689\" src=\"https:\/\/riskinfo.com.au\/news\/files\/2014\/03\/Greg-Medcraft-2.jpg\" alt=\"ASIC Chairman, Greg Medcraft\" width=\"150\" height=\"180\" \/><\/a><figcaption id=\"caption-attachment-25689\" class=\"wp-caption-text\">ASIC Chairman, Greg Medcraft<\/figcaption><\/figure>\n<p>The creation of the new Financial Services Panel was flagged by ASIC as it put out a call for industry consultation and feedback on its plans, which are the result of a recommendation in the 2015 ASIC Capability Review that the regulator consider peer-based co-regulation in its enforcement work.<\/p>\n<p>In releasing <em><a href=\"https:\/\/riskinfo.com.au\/news\/files\/2017\/04\/cp281-published-11-april-2017.pdf\" target=\"_blank\">Consultation Paper 281 Financial Services Panel<\/a>, <\/em>ASIC Chair, <strong>Greg Medcraft<\/strong> said the aim of the Panel was to enhance the impact of ASIC&#8217;s administrative decisions.<\/p>\n<p>\u201cThe significance of being judged by peers cannot be underestimated. Peer review panels are a form of co-regulation in Australia and overseas,\u201d Medcraft said.<\/p>\n<p>\u201cThe Panel will also bring broader experiences and perspectives into ASIC&#8217;s decision making and ensure decisions reflect current industry practices and standards,\u201d he added.<\/p>\n<h6>&#8220;The Panel will also bring broader experiences and perspectives into ASIC&#8217;s decision making&#8230;&#8221;<\/h6>\n<p>Under the proposals, the Panel would usually have three members with two of those members being financial services participants and\/or non-industry participants, such as lawyers or academics, and at least one ASIC staff member.
