{"id":43976,"date":"2019-03-12T20:07:47","date_gmt":"2019-03-12T10:07:47","guid":{"rendered":"https:\/\/riskinfo.com.au\/news\/?p=43976"},"modified":"2019-03-13T06:02:49","modified_gmt":"2019-03-12T20:02:49","slug":"reprieve-for-mortgage-broker-trails","status":"publish","type":"post","link":"https:\/\/riskinfo.com.au\/news\/2019\/03\/12\/reprieve-for-mortgage-broker-trails\/","title":{"rendered":"Reprieve for Mortgage Broker Trails"},"content":{"rendered":"<p>The Government has stepped back from its earlier position on dispensing with trail commissions for mortgage brokers.<\/p>\n<p><!--more--><\/p>\n<figure id=\"attachment_43854\" aria-describedby=\"caption-attachment-43854\" style=\"width: 150px\" class=\"wp-caption alignright\"><a href=\"https:\/\/riskinfo.com.au\/news\/files\/2019\/03\/josh-frydenberg.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-43854\" src=\"https:\/\/riskinfo.com.au\/news\/files\/2019\/03\/josh-frydenberg.jpg\" alt=\"\" width=\"150\" height=\"180\" \/><\/a><figcaption id=\"caption-attachment-43854\" class=\"wp-caption-text\">Treasurer, the Hon Josh Frydenberg&#8230;the Government wants to see more mortgage brokers; not less<\/figcaption><\/figure>\n<p>In a statement released this week, the Federal Treasurer, <strong>Josh Frydenberg<\/strong>, has said that, following consultation with the mortgage broking industry and smaller lenders, &#8220;&#8230;the Coalition Government has decided to not prohibit trail commissions on new loans, but rather review their operation in three years&#8217; time.&#8221;<\/p>\n<p>This announcement differs from the Government&#8217;s initial response to the Banking Royal Commission&#8217;s recommendation 1.3, which called for lenders to be prohibited from paying trail commission to mortgage brokers in respect of new loans, to which the Government&#8217;s original response was that from 1 July 2020, it would prohibit &#8211; for new loans &#8211; the payment of trail commissions from lenders to mortgage brokers and aggregators.<\/p>\n<p>In his release, the Treasurer said the mooted 2022 review is to be conducted by the Council of Financial Regulators and the Australian Competition and Consumer Commission \u2013 a review which he says will also consider the continuation of upfront commissions.<\/p>\n<p>The Treasurer said the Government has already announced:<\/p>\n<ul>\n<li>The best interests duty will legally oblige mortgage brokers to act in the best interests of consumers<\/li>\n<li>A new requirement that the value of upfront commissions be linked to the amount drawn\u2011down by borrowers<\/li>\n<li>A ban on campaign and volume-based commissions<\/li>\n<li>A two year limit on claw-back, starting from 1 July 2020.<\/li>\n<\/ul>\n<p>He says these changes will address conflicts of interest in the industry by better aligning the interests of consumers and mortgage brokers.
