{"id":47084,"date":"2019-11-08T07:56:49","date_gmt":"2019-11-07T21:56:49","guid":{"rendered":"https:\/\/riskinfo.com.au\/news\/?p=47084"},"modified":"2019-11-13T13:56:09","modified_gmt":"2019-11-13T03:56:09","slug":"asic-bans-queensland-adviser","status":"publish","type":"post","link":"https:\/\/riskinfo.com.au\/news\/2019\/11\/08\/asic-bans-queensland-adviser\/","title":{"rendered":"ASIC Bans Queensland Adviser"},"content":{"rendered":"<p class=\"p1\"><span class=\"s1\">ASIC has banned Queensland financial adviser, <strong>Mark Rothnie<\/strong>, for three years for failing to act in the best interests of his clients and for failing to provide appropriate advice.<\/span><\/p>\n<p><!--more--><\/p>\n<figure id=\"attachment_46088\" aria-describedby=\"caption-attachment-46088\" style=\"width: 150px\" class=\"wp-caption alignright\"><a href=\"https:\/\/riskinfo.com.au\/news\/files\/2019\/08\/Danielle-Press-e1566907768772.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-46088\" src=\"https:\/\/riskinfo.com.au\/news\/files\/2019\/08\/Danielle-Press-e1566907768772-250x300.jpg\" alt=\"\" width=\"150\" height=\"180\" srcset=\"https:\/\/riskinfo.com.au\/news\/files\/2019\/08\/Danielle-Press-e1566907768772-250x300.jpg 250w, https:\/\/riskinfo.com.au\/news\/files\/2019\/08\/Danielle-Press-e1566907768772.jpg 417w\" sizes=\"auto, (max-width: 150px) 100vw, 150px\" \/><\/a><figcaption id=\"caption-attachment-46088\" class=\"wp-caption-text\">ASIC Commissioner, Danielle Press &#8230;<span class=\"s1\">advisers are expected to understand their clients\u2019 personal circumstances<\/span><\/figcaption><\/figure>\n<p class=\"p1\"><span class=\"s1\">During ASIC\u2019s surveillance, Rothnie was an authorised representative of Australian financial services licensee, GPS Wealth Limited.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Following the surveillance, the regulator stated it found Rothnie had:<\/span><\/p>\n<ol>\n<li><span class=\"s1\">Failed to properly investigate and document his clients\u2019 relevant financial and personal circumstances<\/span><\/li>\n<li><span class=\"s1\">Failed to give adequate consideration to his clients\u2019 existing insurance products before making a recommendation to switch them, which resulted in clients being worse off<\/span><\/li>\n<\/ol>\n<p><span class=\"s1\">ASIC Commissioner, <strong>Danielle Press<\/strong>, said, \u201cfinancial advisers are expected to understand their clients\u2019 personal circumstances and take those circumstances into consideration when providing personal advice\u201d. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Press added: \u201cWhen recommending that clients switch from an existing life insurance product, advisers must fully consider the risks of the switch and if it is necessary to meet the clients\u2019 goals and objectives.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cAdvisers have a legal obligation to prioritise their clients\u2019 interests and to comply with the best interests duty when providing personal advice.
