{"id":47299,"date":"2019-11-26T14:05:47","date_gmt":"2019-11-26T03:05:47","guid":{"rendered":"https:\/\/riskinfo.com.au\/news\/?p=47299"},"modified":"2019-11-27T06:45:25","modified_gmt":"2019-11-26T19:45:25","slug":"asic-to-take-facilitative-approach-to-adviser-code-standard-3","status":"publish","type":"post","link":"https:\/\/riskinfo.com.au\/news\/2019\/11\/26\/asic-to-take-facilitative-approach-to-adviser-code-standard-3\/","title":{"rendered":"ASIC to Take &#8216;Facilitative Approach&#8217; to Adviser Code Standard 3"},"content":{"rendered":"<p>In what has been welcomed as a victory for common sense, ASIC has announced it will take a facilitative approach to compliance with the controversial Standard 3 in FASEA&#8217;s proposed <a href=\"https:\/\/riskinfo.com.au\/news\/2019\/02\/11\/fasea-releases-12-point-code-of-ethics-for-advisers\/\" target=\"_blank\" rel=\"noopener noreferrer\">Adviser Code of Ethics<\/a> until the Government&#8217;s new single disciplinary body becomes operational.<\/p>\n<p><!--more--><\/p>\n<figure id=\"attachment_47156\" aria-describedby=\"caption-attachment-47156\" style=\"width: 150px\" class=\"wp-caption alignright\"><a href=\"https:\/\/riskinfo.com.au\/news\/files\/2019\/11\/Philip-Kewin-e1573765725464.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\" wp-image-47156\" src=\"https:\/\/riskinfo.com.au\/news\/files\/2019\/11\/Philip-Kewin-e1573765725464.jpg\" alt=\"\" width=\"150\" height=\"180\" srcset=\"https:\/\/riskinfo.com.au\/news\/files\/2019\/11\/Philip-Kewin-e1573765725464.jpg 3029w, https:\/\/riskinfo.com.au\/news\/files\/2019\/11\/Philip-Kewin-e1573765725464-250x300.jpg 250w, https:\/\/riskinfo.com.au\/news\/files\/2019\/11\/Philip-Kewin-e1573765725464-768x923.jpg 768w, https:\/\/riskinfo.com.au\/news\/files\/2019\/11\/Philip-Kewin-e1573765725464-852x1024.jpg 852w\" sizes=\"auto, (max-width: 150px) 100vw, 150px\" \/><\/a><figcaption id=\"caption-attachment-47156\" class=\"wp-caption-text\">AFA CEO, Phil Kewin &#8230;has welcomed ASIC&#8217;s announcement<\/figcaption><\/figure>\n<p>This announcement was made by ASIC as it outlined its approach this week to advice licensee obligations under the code.<\/p>\n<h6>ASIC &#8230;is specifically prevented from exercising its power to ban an adviser for breaches of the code<\/h6>\n<p>The regulator noted it \u201c\u2026will not be monitoring or enforcing individual advisers\u2019 compliance with the Financial Planners and Advisers Code of Ethics 2019.\u201d<\/p>\n<p>The statement also clarified that under the Corporations Act 2001, \u201c\u2026ASIC does not have a role as a code monitoring body and is specifically prevented from exercising its power to ban an adviser for breaches of the code.\u201d<\/p>\n<p>Until the new disciplinary body is operational, the regulator stated, following consultation with FASEA, it will take what it refers to as a facilitative approach to compliance with Code Standard 3 (around conflicts of interest) and Standard 7 (remuneration arrangements) until the new single disciplinary body is operational.<\/p>\n<p>Adviser association reaction has been positive, with AFA CEO, <strong>Phil Kewin<\/strong> positioning this development as a welcome announcement which &#8220;&#8230;recognises the challenges facing licensees and advisers in understanding and being able to practically implement the Code as it is currently written and the associated guidance.&#8221;<\/p>\n<figure id=\"attachment_47322\" aria-describedby=\"caption-attachment-47322\" style=\"width: 150px\" class=\"wp-caption alignright\"><a href=\"https:\/\/riskinfo.com.au\/news\/files\/2019\/11\/Dante-De-Gori_FPA-CEO-cropped.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-47322\" src=\"https:\/\/riskinfo.com.au\/news\/files\/2019\/11\/Dante-De-Gori_FPA-CEO-cropped.jpg\" alt=\"\" width=\"150\" height=\"181\" \/><\/a><figcaption id=\"caption-attachment-47322\" class=\"wp-caption-text\">FPA CEO, Dante De Gori &#8230;also upbeat around this development<\/figcaption><\/figure>\n<p>Meanwhile, FPA CEO, <strong>Dante DeGori<\/strong>, also commended this development, which he says acknowledges the new standards require significant change, and that the FPA supports a facilitative compliance approach on this matter.<\/p>\n<p>ASIC has informed Riskinfo the Government is consulting on the new disciplinary system for financial advisers and the regulator&#8217;s future role in relation to the Code of Ethics will depend on the model the Government eventually implements.<\/p>\n<h6>&#8230;the regulator&#8217;s future role in relation to the Code of Ethics will depend on the model the Government eventually implements<\/h6>\n<p>ASIC stressed advisers will still be required to comply with the code from 1 January 2020 and that AFS licensees will still be required to take reasonable steps to ensure that their financial advisers comply with the code.
