Standard 3"},"content":{"rendered":"<p>FASEA is canvassing industry opinion on amending the wording of the contentious Standard 3 of the Financial Planners &amp; Advisers Code of Ethics.<\/p>\n<p>A statement from the authority says it is considering an amendment to align the wording of the standard to its intent as explained in its 2020 Guide.<\/p>\n<p>FASEA Chief Executive <strong>Stephen Glenfield<\/strong> says that FASEA understands that some stakeholders have raised concerns regarding the wording of Standard 3 \u201c\u2026and welcomes stakeholder feedback on proposed options to align the wording of the standard with the intent of the standard.\u201d<\/p>\n<p>Standard 3 states that advisers &#8220;&#8230;must not advise, refer or act in any other manner where you have a conflict of interest or duty.\u201d<\/p>\n<figure id=\"attachment_48083\" aria-describedby=\"caption-attachment-48083\" style=\"width: 150px\" class=\"wp-caption alignright\"><a href=\"https:\/\/riskinfo.com.au\/news\/files\/2020\/01\/Stephen-Glenfield-from-web.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\" wp-image-48083\" src=\"https:\/\/riskinfo.com.au\/news\/files\/2020\/01\/Stephen-Glenfield-from-web.jpg\" alt=\"\" width=\"150\" height=\"181\" \/><\/a><figcaption id=\"caption-attachment-48083\" class=\"wp-caption-text\">Stephen Glenfield.<\/figcaption><\/figure>\n<p>Glenfield says that the Code of Ethics provides an ethical framework of values and standards to assist advisers in exercising their professional judgement in the best interests of their clients.<\/p>\n<p>The statement explains that based on feedback received from a range of stakeholders on standard 3 since the Code was registered and more recently during the consultation process conducted on the Guide,\u00a0 FASEA is now considering amendment to the wording.<\/p>\n<p><a href=\"https:\/\/www.fasea.gov.au\/fasea-consultation-financial-planners-advisers-code-of-ethics-2019-standard-3\/\" target=\"_blank\" rel=\"noopener\">The consultation paper<\/a> says the authority seeks broad stakeholder feedback through consultation on amending standard 3, specifically on the following options for the working of the standard.<\/p>\n<figure id=\"attachment_58456\" aria-describedby=\"caption-attachment-58456\" style=\"width: 827px\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/riskinfo.com.au\/news\/files\/2021\/11\/FASEA-wording.png\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-58456\" src=\"https:\/\/riskinfo.com.au\/news\/files\/2021\/11\/FASEA-wording.png\" alt=\"\" width=\"827\" height=\"448\" srcset=\"https:\/\/riskinfo.com.au\/news\/files\/2021\/11\/FASEA-wording.png 827w, https:\/\/riskinfo.com.au\/news\/files\/2021\/11\/FASEA-wording-300x163.png 300w, https:\/\/riskinfo.com.au\/news\/files\/2021\/11\/FASEA-wording-768x416.png 768w, https:\/\/riskinfo.com.au\/news\/files\/2021\/11\/FASEA-wording-696x377.png 696w, https:\/\/riskinfo.com.au\/news\/files\/2021\/11\/FASEA-wording-775x420.png 775w\" sizes=\"auto, (max-width: 827px) 100vw, 827px\" \/><\/a><figcaption id=\"caption-attachment-58456\" class=\"wp-caption-text\">Courtesy of FASEA Consultation Paper.<\/figcaption><\/figure>\n<p>The consultation paper also acknowledges \u201c\u2026 ongoing commentary that standard 3 is not workable and that guidance cannot be legally relied upon for interpretation.\u201d<\/p>\n<p>The paper says that FASEA is committed to preserving the intent of the current Code; namely, that financial advice only be offered by advisers who are free from conflict.<\/p>\n<p>\u201cFASEA is also open to making changes to the <em>means<\/em> by which this clear intent is realised through the provisions of its Code.&#8221;<\/p>\n<p><strong>Consultation Interests of FASEA<\/strong><\/p>\n<p>The paper adds that FASEA encourages feedback on Standard 3 and is interested in specific feedback on:<\/p>\n<ul>\n<li>Which, if any, of the three options, as offered above you prefer<\/li>\n<li>Other wording you might propose that is clearly for the purpose of realising the current (and continuing) intent of Standard 3, with a focus on making that intent clear and to enable effective implementation<\/li>\n<li>The practical application of options 1,2 and 3 in terms of: consumer experience;
