{"id":64077,"date":"2023-01-09T16:21:39","date_gmt":"2023-01-09T05:21:39","guid":{"rendered":"https:\/\/riskinfo.com.au\/news\/?p=64077"},"modified":"2025-03-14T12:02:24","modified_gmt":"2025-03-14T01:02:24","slug":"licensees-on-notices-over-tax-financial-advice-status","status":"publish","type":"post","link":"https:\/\/riskinfo.com.au\/news\/2023\/01\/09\/licensees-on-notices-over-tax-financial-advice-status\/","title":{"rendered":"Licensees on Notice Over Tax (Financial) Advice Status"},"content":{"rendered":"<div class=\"header row\">\n<div class=\"intro\">\n<h3>Our report on upcoming changes to ASIC&#8217;s Financial Adviser Register generated most interest from advisers this week, as the industry awakens from its festive season slumber&#8230;<\/h3>\n<\/div>\n<\/div>\n<p>ASIC has announced that from February 1, the Financial Advisers Register (FAR) will display whether a financial adviser can provide tax (financial) advice services to retail clients.<\/p>\n<p>This move reflects new requirements for advisers who provide, or intend to provide, tax (financial) advice services to retail clients, which came into effect on 1 January, 2022. Those new requirements are:<\/p>\n<ul>\n<li>Completion of specified courses in commercial law and taxation law (some exceptions apply)<\/li>\n<li>Additional continuing professional development requirements<\/li>\n<\/ul>\n<p>Financial advisers who meet these requirements are known as \u2018qualified tax relevant providers\u2019 (QTRPs).<\/p>\n<p>However, financial advisers who were registered with the Tax Practitioners Board as individual tax (financial) advisers at the relevant time are taken to be QTRPs under transitional arrangements. ASIC has notified these advisers and their respective AFS licensees of their QTRP status, and has applied this information to the adviser\u2019s FAR record.<\/p>\n<p>If an adviser\u2019s QTRP status hasn\u2019t already been recorded on the FAR, licensees must notify ASIC before 1 February 2023 by updating the adviser\u2019s details on ASIC Connect.<\/p>\n<blockquote><p>&#8230;it is the responsibility of AFS licensees to ensure that the details &#8230;about their financial advisers is correct<\/p><\/blockquote>\n<p>If the adviser\u2019s status is not updated by 1st February, the FAR will not display whether the adviser can provide tax (financial) advice services.
