AFS Licence Suspended

The AFS licence of MW Planning Pty Ltd has been suspended until 8 June 2026 by ASIC, which cited the firm’s failure to meet organisational competence and human resources obligations.

ASIC said the firm did not appoint a new responsible manager following the banning of its previous responsible manager, Robert John Tohill, on 25 August 2025.

The regulator also found that MW Planning failed to lodge its 2024 financial statements and auditor’s opinion, and did not report these breaches.

MW Planning, which holds AFS licence number 312489, is a subsidiary of MWL Financial Group Pty Ltd, currently in administration. The parent company also owns MWL Financial Services Pty Ltd, which is in liquidation.

In August 2025, ASIC cancelled the AFS licence of MWL Financial Services and banned Tohill from providing financial services.

During the suspension period, MW Planning is required to remain a member of AFCA and maintain professional indemnity insurance. The firm has the right to seek a review of ASIC’s decision through the Administrative Review Tribunal.
